The Turkish Ministry of Justice’s official commissioner training book explains that temporary respite lasts three months and may be extended by up to two months, for a maximum of five months. Where success appears possible, definitive respite is granted for one year and may be extended by up to six months in a difficult special case.
Why temporary respite is not bankruptcy
Temporary respite creates a period in which the application and preliminary project can be examined. The court appoints one or more temporary commissioners and publishes the decision. A published official example separately states the start date, duration, commissioners, measures, objection period and hearing date.
The accurate statement may be “temporary respite was announced for the company on this date”, not “the company went bankrupt”. Never make the signal stronger than the court order.
